Full Record Expungement

Full record expungement is the most difficult type of expungement to obtain because it’s the most thorough. This expungement will remove your criminal record from arresting agencies, the Oklahoma Bureau of Investigation’s records, and the court’s records. In addition, when asked if you have a criminal record, this expungement allows you to answer, “no.”

In order to qualify for a full expungement, there are twelve qualifying situations a person can fall under. You’ll qualify for a full expungement if:

• You were arrested but received no charges.
• You were under 18 when you were arrested and received a pardon.

• You were charged with a misdemeanor and the charge was dismissed following the successful completion of a deferred judgment or delayed sentence. You’ve never been convicted of a misdemeanor or felony, no misdemeanor or felony charges are pending against you, and at least two years have passed since the charge was dismissed.
• You were charged with a nonviolent felony offense and the charge was dismissed following the successful completion of a deferred judgment or delayed sentence. You’ve never been convicted of misdemeanor or felony, no misdemeanor or felony charges are pending against you, and at least 10 years have passed since the charge was dismissed.
• You were convicted of a misdemeanor offense and you’ve never been convicted of any other misdemeanor or felony. No felony or misdemeanor charges are pending against you, and at least 10 years have passed since the conviction.
• You were convicted of a nonviolent felony offense and you received a full pardon for the offense. You’ve never been convicted of any other misdemeanor or felony, no felony or misdemeanor charges are pending against the person, and at least 10 years have passed since the conviction.
• You were charged, arrested or had a warrant for your arrest for a crime that was committed by another person who used your name without your permission.

Deferred Sentence Expungement

A deferred sentence is a time limit set by the judge in which your criminal record will be kept on file until expungement will be allowed. For instance, you can avoid jail time by getting a deferred sentence of five years on a drug possession charge. During this time, you’ll need to abide by whatever the judge orders, which can include probation, community service and staying out of trouble.
